These Terms & Conditions (“Terms”) govern your access to and use of the Cyclops Optics Limited website (the “Site”) and any purchase of products, gift cards, or services from Cyclops Optics Limited (“Cyclops”, “we”, “us”, or “our”).
By using the Site or placing an order, you agree to be bound by these Terms. If you do not agree, do not use the Site.

2) Who We Sell To
We sell to consumers (B2C) and businesses or institutions (B2B).
If you purchase on behalf of a business or institution, you represent and warrant that you have authority to bind that business or institution to these Terms.
3) Site Use & Acceptable Conduct
You agree not to:

misuse the Site or attempt unauthorised access;

scrape, harvest, or copy Site content or data at scale;

interfere with Site security, availability, or performance;

use the Site in breach of applicable laws or regulations, including export control and sanctions laws.
We reserve the right to suspend, restrict, or terminate access if we reasonably suspect fraud, abuse, unlawful activity, or violation of these Terms.
4) Product Information, Compatibility & Advice
We aim to ensure product descriptions, images, specifications, and pricing are accurate. However:

product images are illustrative and packaging or appearance may vary;

manufacturers may change specifications without notice;
-
compatibility depends on your specific equipment, configuration, and use case.
You are responsible for verifying compatibility (including threads, adapters, backfocus, power requirements, firmware/software support, mount standards, and environmental suitability) before purchasing.
Any guidance we provide is general in nature and does not replace your own verification or professional judgment.
5) Pricing, Currency & Pricing Errors
Transactional currency: HKD.
We may display USD, EUR, MYR, or other currencies for reference only. These are estimates and your card issuer or payment provider may apply its own exchange rates and fees. Unless expressly agreed otherwise in writing, you will be charged in HKD.
If a pricing or description error occurs, we reserve the right to cancel the affected order (even after payment) and issue a refund. We do not honour obvious pricing errors.
6) Taxes, Duties & Import Charges
Unless expressly stated, prices exclude import duties, customs fees, brokerage or handling fees, VAT/GST/sales tax, and any local taxes in your destination. You are solely responsible for all such charges.
If a shipment is returned to us because duties or taxes were not paid, customs clearance failed, or delivery was refused, we may refund the product price minus:

outbound shipping costs;
-
return shipping costs;
-
non-refundable payment processing fees;
-
customs, handling, or return-related fees;
-
any losses incurred by Cyclops.
7) Orders, Acceptance & Cancellation
Submitting an order constitutes an offer to buy. An order is accepted only when we confirm acceptance and/or dispatch the goods.
We may refuse or cancel any order at our discretion, including due to suspected fraud, verification failure, export or shipping restrictions, stock issues, or pricing errors.
Pre-dispatch cancellation:
You may request cancellation before dispatch, but approval is not guaranteed once processing has started (including packing, allocation, or supplier ordering). If approved, we may deduct non-recoverable costs such as payment fees, bank charges, foreign exchange losses, or special-order deposits.
8) Payments & Fraud Screening
We accept PayPal, credit/debit cards (via Stripe and Airwallex), and bank transfers.
To prevent fraud and chargebacks, we may request additional verification (including government ID, proof of address, selfies, or unboxing videos) prior to dispatch. Orders that fail verification may be cancelled and refunded.
Successful 3D Secure authentication reduces certain fraud risks but does not eliminate non-fraud disputes (e.g. “item not received” or “not as described”). Verification may still be required for higher-risk transactions.
If your payment is reversed, charged back, or later found to be unauthorised, you remain liable for the full amount plus any fees and recovery costs incurred by Cyclops.
9) International Shipping, Delivery & Risk
9.1 Shipping Basis (DAP/DDU)
By default, orders are shipped delivery duty unpaid (DAP/DDU). Duties-paid shipping (DDP) may be offered only by special written arrangement.
9.2 Delivery Times
Delivery dates are estimates only and not guaranteed. Delays may occur due to carriers, customs clearance, weather, peak seasons, or events beyond our control.
9.3 Delivery Confirmation
Delivery is deemed complete when the carrier records the shipment as delivered (including signature, delivery scan, or photo proof) to the address you provided.
9.4 Address Accuracy
You must provide a complete and accurate shipping address and reachable contact details. If a shipment is lost, delayed, or returned due to incorrect or incomplete information, you are responsible for reshipping and associated costs.
9.5 Risk of Loss & Title
To the maximum extent permitted by law, risk of loss passes to you when the shipment is handed to the carrier. Title passes upon full payment.
9.6 Restricted Destinations & Sanctions
We do not ship to sanctioned destinations and may refuse shipping to locations we deem high-risk due to fraud, loss, or regulatory concerns. You are responsible for ensuring products are legal to import and use in your destination.
9.7 Lithium Batteries & Dangerous Goods
Certain items (including lithium battery power stations) may be subject to dangerous goods regulations and carrier limitations. We may change carriers, apply surcharges, restrict destinations, or cancel/refund orders if shipment is not feasible.
10) Returns, Refunds & Exchanges (RMA Policy)
All returns require prior written approval and an RMA. Unauthorised returns may be rejected or returned at your cost.
10.1 Change-of-Mind Returns
Change-of-mind returns may be accepted if requested within 14 days of delivery, subject to condition and approval.
Returned items must be new, unused, uninstalled, and returned with all original packaging, accessories, inserts, manuals, seals (if any), and freebies intact, in resalable condition.
Return shipping for change-of-mind returns is borne by the buyer. Shipping fees, duties, taxes, and brokerage fees are non-refundable unless required by law.
10.2 Refund Processing Fee (Change-of-Mind Only)
For approved change-of-mind returns, we will deduct a refund processing and administrative fee equal to 5% of the original order value, not the refunded amount.
This fee:
-
reflects non-refundable payment gateway fees and administrative costs;
-
applies to full and partial returns;
-
is in addition to any applicable restocking fee;
-
does not apply to confirmed DOA, defective, or wrongly shipped items.
Where an order contains multiple items, the refund processing fee is calculated based on the total original order value, regardless of whether a full or partial return is requested.
10.3 Restocking Fees & Condition Assessment
Standard restocking fees apply only where the returned condition matches what was declared at the time of the return request:
-
5% — new and unopened items
-
10% — opened but unused items (if approved)
-
10–20% — compromised packaging, cosmetic wear, missing accessories, or reduced resale value
If, upon inspection, the returned item is in worse condition than declared, has undisclosed use, damage, missing parts, contamination, or altered packaging, Cyclops reserves the right to:
-
increase the restocking fee to reasonably reflect actual loss; or
-
refuse the return entirely.
If a return is refused, the item(s) will be returned to the customer and all costs associated with returning the item(s) (including shipping, insurance, customs duties, taxes, and handling) shall be borne by the customer.
Approval of a return is conditional upon the returned item(s) matching the declared condition.
10.4 Defective / DOA
DOA or defect-on-arrival claims must be reported within 7 days of delivery. Evidence may include photos, serial numbers, packaging, troubleshooting steps, fault videos, and mandatory unboxing videos for orders or items above USD 500 (or HKD equivalent).
If confirmed, we will at our option replace, repair, or refund. For confirmed DOA cases, we pay return shipping using our selected method. If no defect is found, you may be responsible for shipping costs both ways.
10.5 Wrong Item Shipped
If we shipped the wrong item, notify us within 7 days. We will arrange return shipping and replacement at our cost.
10.6 Shipping Damage
Shipping damage must be reported within 48 hours of delivery and all packaging must be retained. Failure to do so may invalidate carrier claims.
10.7 Refund Timing
Refunds are issued to the original payment method after inspection. Inspection may take up to 7 working days after receipt. Payment providers may take additional time to post refunds.
11) Warranty
Most products are covered by the manufacturer’s warranty. Cyclops generally assists with warranty claims, but the manufacturer or authorised service centre determines eligibility, repair/replacement, and timelines.
Unless required by law, warranties may be void for misuse, modification, improper installation, liquid damage, power surge damage, or unauthorised repair. After the DOA window, you may be responsible for shipping and any import/VAT implications.
12) Safety Warnings (Optics & Electronics)
Astronomy equipment can be hazardous if misused.
Never observe the Sun without proper certified solar filtration.
Follow manufacturer safety instructions for lasers, power supplies, batteries, heaters, and electronics.
You assume responsibility for safe setup, use, and compliance with local laws.
13) Gift Cards
Gift cards are not redeemable for cash (except where required by law). We may apply verification checks. Gift cards are non-refundable once issued, except where required by law.
14) Services
Services may be customised and scoped case-by-case. Unless otherwise agreed in writing:
-
a 20% booking fee may be required and is non-refundable once booked;
-
cancellations before preparation commences will be refunded above the 20%;
-
cancellations after preparation or no-shows may be charged up to the full service price;
-
rescheduling may require at least 48 hours’ notice.
15) Resellers & Third-Party Purchasers
We do not prohibit resale or promotional use. However, warranty and after-sales assistance generally require proof of purchase and may be limited to the original purchaser or order.
16) Limitation of Liability
To the maximum extent permitted by law:
-
our total liability is limited to the amount paid for the specific product or service giving rise to the claim;
-
we are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenue, data, goodwill, or business.
Nothing limits liability that cannot legally be limited.
17) Chargebacks & Disputes
Before initiating a chargeback, you agree to contact us to attempt resolution. Unfounded chargebacks may result in account restrictions, order cancellation, and recovery of fees and losses incurred.
18) Intellectual Property
All Site content (including text, images, product pages, guides, logos, and branding) is owned by or licensed to Cyclops and protected by intellectual property laws. Unauthorised use is prohibited.
19) Privacy
Your personal data is handled in accordance with our Privacy Policy, which forms part of these Terms.
20) Governing Law & Dispute Resolution
These Terms are governed by the laws of Hong Kong.

B2C: exclusive jurisdiction of Hong Kong courts, subject to mandatory consumer laws.

B2B: disputes resolved by arbitration administered by the Hong Kong International Arbitration Centre (HKIAC) under HKIAC Administered Arbitration Rules. Seat: Hong Kong. Language: English. One arbitrator.
21) Changes to These Terms
We may update these Terms from time to time by posting a revised version on the Site. Continued use constitutes acceptance.
22) Severability
If any provision is held unenforceable, the remainder remains in full force and effect.
